These Terms & Conditions ("Terms") govern your use of Holiday Properties Australia (the "Site"). By accessing or using the Site, you are taken to have read, understood, and accepted these Terms. If you do not accept them, please do not use the Site.
These Terms should be read together with our Disclaimer and Privacy Statement, which also apply to your use of the Site.
1. Use of the Site and Content
You may access and use the Site for personal, non-commercial purposes. All content on the Site is provided for general information and educational purposes only and does not constitute legal, financial, taxation, conveyancing, valuation, or other professional advice. Please read our full Disclaimer before relying on any content.
We may add, change, suspend, or remove free Site content or features from time to time. Where this materially affects a paid product or service, we will act reasonably and comply with any rights you have under the Australian Consumer Law.
2. Intellectual Property
Unless otherwise stated, all content on the Site — including text, articles, graphics, logos, layouts, and downloads — is owned by or licensed to us and is protected by Australian and international copyright and other intellectual property laws.
You may not reproduce, republish, transmit, sell, or commercially exploit any content from the Site without our prior written permission. You may print or save a reasonable number of copies for your own personal, non-commercial use, provided that you retain all copyright and attribution notices. Brief quotation with a visible link back to the original article is welcome.
3. Comments and User Submissions
Where the Site allows comments or other user contributions, you grant us a non-exclusive, royalty-free, perpetual licence to publish, reproduce, and moderate your contribution in connection with the Site.
By submitting content, you warrant that:
- you own or have the right to submit it;
- it does not infringe any third party's rights; and
- it is not unlawful, defamatory, misleading, harassing, abusive, or spam.
We reserve the right, at our discretion, not to publish, to edit, or to remove any user contribution at any time. Your contributions remain your responsibility — see section 7 (Indemnity). The views in user contributions are not ours, and we do not endorse them.
4. Prohibited Use
When using the Site, you must not:
- use the Site for any unlawful purpose or in breach of any Australian law;
- transmit spam, malware, or use automated extraction, harvesting, bulk downloading, or data collection tools (beyond permitted caching by your browser);
- attempt to gain unauthorised access to the Site, its systems, or other users' information;
- impersonate any person or misrepresent your affiliation with any entity; or
- interfere with or disrupt the Site or its hosting infrastructure.
5. Newsletter and Communications
By subscribing to our newsletter or providing your email address, you consent to us sending you the communications you have signed up to receive, in accordance with the Spam Act 2003 (Cth). Every marketing email we send will contain a working unsubscribe facility and clear identification of the sender. You may unsubscribe at any time using the link in any email, or by contacting us at contact@estateassets.com.au.

6. Third-Party Links, Affiliates, and Advertisements
The Site may contain links to third-party websites and may include affiliate or sponsored content, which we disclose in the relevant article or page. We do not control or endorse third-party websites and accept no responsibility for them. Your use of third-party websites is at your own risk and subject to their own terms and privacy policies. 7. Indemnity
To the maximum extent permitted by law, you indemnify us against any loss, damage, cost, or expense (including reasonable legal costs) that we incur arising from: (a) your breach of these Terms; (b) your unlawful use of the Site; or (c) content you submit to the Site.
8. Limitation of Liability and the Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law, set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), or under any other law, where such exclusion, restriction, or modification is not permitted by law.
Subject to those non-excludable rights, and to the maximum extent permitted by law:
- our liability arising from or connected with your use of the Site, its content, or any products or services supplied through it is limited; and
- where our liability for a breach of a non-excludable consumer guarantee concerning services cannot lawfully be excluded, our liability is limited, at our option, to the resupply of the services, or the payment of the cost of having the services supplied again.
9. Termination
We may suspend or terminate your access to the Site, or any part of it, where we reasonably believe you have breached these Terms, used the Site unlawfully, or where suspension is reasonably necessary for security, operational, or legal reasons. Sections that by their nature should survive termination (including intellectual property, indemnity, and limitation of liability) continue to apply.
10. Changes to These Terms
We may update these Terms from time to time. The current version will be published on this page with the date of last update. Continued use of the Site after changes are published means you accept the updated Terms.
11. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down to the maximum extent permitted, and the remaining provisions continue in full force. Our failure to act on a breach does not waive our rights in respect of that or any other breach.
12. Governing Law
These Terms are governed by the law in force in New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
